With your payment for this Cruise (Oskar Blue Sunset Cruise 2017 ), you agree to the following Terms and Conditions:
I understand that I and anyone traveling with me must be at least 21 years of age by the sail date Aug 17 2017. Anyone under the age of 21 years will not be able to board the ship and No Refunds will be given.
No Refunds will be given, but Tickets are Transferrable.
Travel and Limitation of Liability. By your purchase of a ticket to the Cruise, you acknowledge that you are willing to travel to Capital Cruises, 208 Barton Springs Rd, Austin, TX 78704. You are solely responsible for making your own travel and accommodation arrangements and all costs thereof associated with getting to the Capital Cruises.
YOU AGREE THAT CRAFT BEER AUSTIN and OSKAR BLUE BREWERY WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, AND REGARDLESS OF WHETHER OR RESIGNATION WAS OR SHOULD HAVE BEEN AWARE OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
Indemnification. You agree to indemnify and hold harmless CRAFT BEER AUSTIN and OSKAR BLUES BREWERY from and against any and all claims, demands, actions or causes of action, losses, damages, lawsuits, debts, proceedings, fees (including court costs and reasonable attorney’s fees), and judgments, caused by, arising from, or relating to your participation in or attendance at this Cruise.
RELEASE OF LIABILITY. YOU HERE RELEASE, WAIVE, ACQUIT, DISCHARGE, COVENANT NOT TO SUE, AND HOLD HARMLESS CRAFT BEER AUSTIN and OSKAR BLUES BREWERY FROM ANY AND ALL LIABILITIES, INJURIES (INCLUDING DEATH), DAMAGES, CLAIMS, DEMANDS, ACTIONS OR CAUSES OF ACTION, LOSSES, SUITS, DEBTS, PROCEEDINGS, FEES (INCLUDING COURT COSTS AND REASONABLE ATTORNEY’S FEES), AND JUDGMENTS, IN LAW OR IN EQUITY, ARISING FROM OR RELATING TO YOUR PARTICIPATION IN OR ATTENDANCE DURING THE CRUISE, CAUSED BY, ARISING FROM, OR OCCURRING FOR ANY REASON WHATSOEVER, INCLUDING BUT NOT LIMITED TO, DAMAGES TO YOUR PERSON OR PROPERTY, VIOLATION OF RIGHTS OF PRIVACY OR PUBLICITY, AND/OR THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE, STATUTORY FAULT, OR STRICT LIABILITY OF RESIGNATION.
