Governor Abbot issued an executive order this morning closing businesses that receive more than 51% of their gross receipts from the sale of alcoholic beverages starting at 12 p. m. today:

“These businesses may remain open for delivery and take-out, including for alcoholic beverages, as authorized by the Texas Alcoholic Beverage Commission.”

Earlier this week the Governor highlighted the need for wearing masks in public places and encouraged people to stay home if possible. He also paused the previous timeline for the  Open Texas Plan.

Breweries and brewpubs that close their taprooms are still offering beer-to-go!

“As I said from the start, if the positivity rate rose above 10 percent, the State of Texas would take further action to mitigate the spread of COVID-19,” Abbott said. “At this time, it is clear that the rise in cases is largely driven by certain types of activities, including Texans congregating in bars.”

Technically, any brewpub or brewery with less than 51% of their gross receipts coming from the sale of alcoholic beverages (displays the blue sign) would be allowed to remain open in accordance with the requirements laid out by the Open Texas guidance, which now requires only allowing 50% dining capacity, adhering to social distancing, sanitizing procedures and providing disposable menus, among other measures.
